Privacy Policy

This Privacy Policy explains how Cubria (“Cubria,” “we,” “us,” or “our”) collects, uses, and shares information when you use our website and our estimating, quoting, and contract software (the “Service”). Cubria is based in Greenville, South Carolina, United States. By using the Service, you agree to this Policy.

Who this applies to

The Service is built for businesses. If you use Cubria on behalf of an organization, that organization is the controller of the business and job data it puts into the Service, and this Policy governs how we process that data on its behalf as described in our agreement with it.

Information we collect

• ✓Account & organization details. When you sign up we and our authentication provider collect your name, email address, and password credentials, your organization name, and the teammates you invite. Sign-in and credentials are handled by our authentication provider (Clerk); we do not store your password.
• ✓Customer Content. The documents, plans, project specifications, cost history, quotes, contracts, and other materials you upload or create in the Service.
• ✓Billing information. Plan, subscription status, and billing contact. Payments are processed by our billing and payment processors (Clerk and Stripe); we do not receive or store full payment card numbers.
• ✓Usage & device data. Log data such as IP address, browser and device type, pages viewed, features used, and timestamps, collected to keep the Service secure, reliable, and fast.
• ✓Communications. If you contact us or submit a demo or contact request, we collect your name, company, email, trade, and the contents of your message.

How we use information

We use information to provide, maintain, and improve the Service — including reading your documents to build project specs, pricing quotes from your organization's own history, and generating contracts; to set up and secure accounts; to process billing; to provide support; to send service and, where permitted, marketing communications (which you can opt out of); to monitor and improve performance and security; and to comply with legal obligations.

AI processing

Cubria uses artificial intelligence to power core features. To extract project specifications and generate quotes and contracts, relevant Customer Content is sent to our AI provider (Anthropic) for processing. Under our agreement with that provider, your Customer Content submitted through its API is not used to train its models. AI output is generated to assist you and may contain errors; you are responsible for reviewing it (see our Terms).

How we share information

We do not sell your personal information or your Customer Content, and we do not use one organization's Customer Content to price another organization's work or to benefit other customers. We share information only with:

• ✓Service providers (subprocessors) who help us run the Service, including: Clerk (authentication and subscription billing), Stripe (payment processing), Google (Cloud hosting, database, and file storage, and Google Analytics for usage analytics), Anthropic (AI processing), and Formspree (demo and contact form handling). Each is bound to protect your data and use it only to provide their service to us.
• ✓Legal and safety reasons — to comply with law, enforce our agreements, or protect the rights, safety, and security of Cubria, our users, or the public.
• ✓Business transfers — if Cubria is involved in a merger, acquisition, or sale of assets, information may transfer as part of that transaction, subject to this Policy.

Cookies & analytics

We use cookies and similar technologies that are necessary to sign you in, keep the Service secure, and remember your preferences, and we use analytics (including Google Analytics) to understand how the website and Service are used. Google Analytics sets cookies and processes usage data (such as your IP address) on our behalf to provide these insights. You can control cookies through your browser settings, though some features may not work without them.

Data retention

We keep your information for as long as your account is active and as needed to provide the Service. After an account is closed, we delete or de-identify Customer Content within a reasonable period, except where we must retain certain records to comply with legal, tax, accounting, or security obligations.

Security

We use industry-standard administrative, technical, and physical safeguards — including encryption in transit and access controls — to protect your information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

Your rights & choices

Depending on where you live, you may have the right to access, correct, export, or delete your personal information, to object to or restrict certain processing, and to opt out of marketing. You can manage much of your account data in the app, and you can request export or deletion at any time by emailing privacy@cubria.co. If you use Cubria as part of an organization, we may direct your request to that organization. We will not discriminate against you for exercising these rights.

Data location & children

Cubria is operated in the United States, and your information is processed there. The Service is intended for businesses and is not directed to children under 18; we do not knowingly collect personal information from children.

Changes to this Policy

We may update this Policy from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you.

Terms of Service

These Terms of Service (“Terms”) are an agreement between you (and, if applicable, the organization you represent) and Cubria governing your use of our website and Service. By creating an account or using the Service, you agree to these Terms. If you are using Cubria on behalf of an organization, you represent that you are authorized to bind that organization.

Eligibility & the Service

You must be at least 18 years old and able to form a binding contract to use the Service. Cubria provides software to help contractors and builders extract project specs, build estimates and quotes from their own data, and generate contract documents. We may update, add, or remove features over time.

Your account & organization

You are responsible for your account, for keeping your credentials secure, and for all activity under your account and organization, including teammates you invite. Notify us promptly of any unauthorized use. Organization administrators may manage, access, and remove members and their access to organization data.

Free trial

We may offer a free trial (currently 30 days of the Pro plan). A payment method may be required to start a trial. Unless you cancel before the trial ends, your subscription will begin and the payment method on file will be charged for the plan you selected. You can cancel at any time during the trial to avoid charges.

Plans, billing & renewal

• ✓Paid plans are billed in advance on a monthly or annual basis and automatically renew until cancelled.
• ✓You can upgrade, downgrade, or cancel at any time; plan changes take effect as described at checkout (e.g., proration for mid-cycle changes). Cancellation stops future renewals; access continues through the end of the paid period.
• ✓Fees are exclusive of taxes, which you are responsible for. Except where required by law, payments are non-refundable. We may change pricing with reasonable advance notice, effective on your next renewal.
• ✓Plans include limits (such as seats and monthly projects); additional usage may incur additional fees as described on our pricing page.

Acceptable use

You agree not to:

• ✓use the Service unlawfully, or to upload content you don't have the right to use;
• ✓copy, resell, reverse-engineer, or attempt to extract the source code of the Service, except as permitted by law;
• ✓interfere with or disrupt the Service, probe its security, or access it in an automated or abusive way; or
• ✓use the Service to build or train a competing product.

Your content is yours

As between you and Cubria, you own your Customer Content and the quotes and contracts you generate. You grant us a limited license to host, process, and display that content solely to provide and improve the Service for you. You are responsible for your content and for ensuring you have the rights to use it. We will handle your content in accordance with our Privacy Policy.

AI features & no guarantee on estimates

Cubria uses AI to assist with specs, pricing, and contracts. Its output is decision-support, not professional, legal, financial, or engineering advice, and it may be inaccurate or incomplete. You are solely responsible for reviewing and verifying every number, document, and contract before you rely on it, send it, or submit a bid. Cubria is not responsible for business decisions, bids, or contracts you make using the Service.

Our intellectual property

The Service, including its software, design, and trademarks, is owned by Cubria and protected by law. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as permitted here.

Third-party services

The Service relies on third-party providers (such as authentication, payments, hosting, and AI). Your use may also be subject to their terms, and we are not responsible for third-party services we do not control.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, Cubria will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the 12 months before the event giving rise to the claim.

Indemnification

You agree to indemnify and hold Cubria harmless from claims and expenses arising out of your Customer Content, your use of the Service, or your violation of these Terms or applicable law.

Termination

You may stop using and cancel the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. On termination, your right to use the Service ends; you may request export of your Customer Content as described in our Privacy Policy.

Governing law & disputes

These Terms are governed by the laws of the State of South Carolina, USA, without regard to conflict-of-laws rules. The state and federal courts located in South Carolina will have jurisdiction over disputes, and you consent to venue there. We encourage you to contact us first so we can try to resolve any issue informally.

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Continued use of the Service after changes take effect means you accept the updated Terms.
